Terms and Conditions for Electronic and Automatic Payment
By accessing and using the Star Gas Products, Inc. electronic and automatic payment web site, you agree to be bound by the following terms and conditions, in addition to and subject to the terms and conditions of any other current agreement you may have with Star Gas Products, Inc. If you do not agree to these terms and conditions, you should not complete the registration process. YOUR CLICKING ON THE BUTTON MARKED “I AGREE” AND PROCEEDING TO USE STAR GAS PRODUCTS, INC. ’S ONLINE PAYMENT SERVICES INDICATES YOUR ACKNOWLEDGMENT THAT YOU HAVE READ AND ACCEPTED THESE TERMS AND CONDITIONS AND THAT YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ANY FUTURE AMENDMENTS THAT MAY BE MADE FROM TIME TO TIME.
These terms and conditions shall be governed by the laws of the State of New York, without regard to the conflict of law rules thereof.
You should print and retain this document and any updated or amended terms and conditions for safekeeping and reference at any time during your usage of the online payment services.
General Terms and Conditions
You acknowledge that communications or transactions conducted online are not absolutely secure. You agree to assume all risk and liability arising from your use of Star Gas Products, Inc.’s online payment services, including the risk of breach in the security of the communications or transactions you conduct with Star Gas Products, Inc. online. You further acknowledge that there may be system failures that may limit your ability to use the online payment services. In the event of a system failure or interruption while using the online payment services, your data may be lost or destroyed. Any transaction(s) that you initiated, were in the process of completing, or completed shortly before a system failure or interruption should be verified by you to ensure the accuracy and completeness of such transactions(s). You assume the risk of loss of your data during any system failure or interruption and the responsibility to verify the accuracy and completeness of any transactions so affected. STAR GAS PRODUCTS, INC. ’S ONLINE PAYMENT SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE. In no event shall Star Gas Products, Inc. ever be liable for any direct, indirect, special, incidental, consequential, or exemplary damages, including lost profits (even if advised of the possibility of such damages) arising in any way out of your use of the online payment services.
You represent that you are of legal age to form a binding contract (at least 18 years old). You agree that Star Gas Products, Inc. may send you electronic communications related to your use of Star Gas Products, Inc. ’s online payment services, including, but not limited to, confirmation of payments made, notice of credit card expirations, and other purposes as Star Gas Products, Inc. deems to be appropriate.
You are solely responsible for maintaining the confidentiality of your password and agree not to give your password to anyone else. Should you allow others access to your account and/or password information, you will be responsible for all actions that such persons might take with respect to your account. If you believe your password has been lost or stolen or someone has gained access to your password without your permission, call our office immediately at 845-452-8400. Unauthorized individuals attempting to access password protected and/or secure areas of the online payment services may be subject to prosecution.
You agree to provide Star Gas Products, Inc. with current, accurate and complete information required by the online registration. You further agree to provide Star Gas Products, Inc. with current, accurate, and complete data when utilizing the online payment services. You agree to notify Star Gas Products, Inc. immediately of any changes in your registration data. If you have not already done so, we urge you to review our Privacy Policy (which is hereby supplemented to provide that the information we collect from you as part of your usage of the online payment services will be used, by us and by the financial institution(s) we have engaged to operate our online payment services on our behalf, to process your payment transactions) and our Terms of Use.
Star Gas Products, Inc. may at any time and without prior notice make changes to, or discontinue, any of its online payment services and/or these terms and conditions, and may require re-enrollment if the service or these terms and conditions are modified. We will post any such changes on this web site and you are encouraged to access and review these terms and conditions on a regular basis. Star Gas Products, Inc. may terminate online payment services for your account if, without limitation, we receive conflicting instructions, if your account is in default of this Agreement or otherwise not in good standing, or if we determine that an online payment service is being used improperly. If Star Gas Products, Inc. terminates your use of the online payment services for any reason, you will need to pay your amounts due to Star Gas Products, Inc. in another manner. If you enroll your account for an online payment service, it will mean that you agree not to make a claim against Star Gas Products, Inc. relating to its online payment services and that you will hold Star Gas Products, Inc. harmless from any claim, liability or damage resulting from any online payment service, or your use or inability to use the same, in connection with your account.
To Report an Unauthorized Transaction: Contact Customer Service immediately at 845-452-8400, or send an email to cindy@stargasproducts.com. Customer Service is available 8:00 a.m. to 5:00 p.m. ET Monday – Friday (except for Thanksgiving, Christmas and New Year’s Day).
Notify us in case of errors or questions about your bill.
If you think your bill is wrong, or if you need more information about a transaction on your bill, write us in a separate letter at the mailing address on your billing statement. Write us as soon as possible. We must hear from you no later than 90 days after we have sent you the first bill on which the error or problem appeared. You can telephone us, or send an e-mail, but doing so will NOT preserve your rights.
In your letter, give us the following information:
- Your name and Account number
- The dollar amount of the suspected error
- Describe the error and explain, if you can, why you believe there is an error. If you need more information, describe the item you are not sure about.
If you have authorized us to pay your bill automatically from a checking account, you can stop the payment on any amount you think is wrong. To stop the payment your letter must reach us three business days before the automatic payment is scheduled to occur.
One Time Payment Electronic Payment Authorization
By completing the One Time Payment online registration, including supplying the required checking account or credit card information, you authorize Star Gas Products, Inc. to debit your checking account or charge your credit card for your scheduled payment amount on the date indicated, including any applicable transaction fees (One Time payment is not an automatic payment for every invoice, but rather is only a one time payment; see the next section for our Registered On-Line Bill Payment service). You also authorize Star Gas Products, Inc. to, upon notification by you or your financial institution, modify and/or update the account numbers, expiration dates, or other pertinent information associated with One Time Payment as necessary to complete any authorized transaction. Please review your statement/invoice for accuracy. You understand and agree that Star Gas Products, Inc. is not liable for incorrect debits to your account resulting from errors on your statement/invoice (see the section above for how you can report errors on your statement/invoice to Star Gas Products, Inc.). This authorization does not alter in any way the terms and conditions of your customer agreement with Star Gas Products, Inc.. Star Gas Products, Inc. is not responsible for any financial institution fees you may incur as a result of your participation in this program.
If any electronic payment is returned unpaid by your financial institution for any reason, Star Gas Products, Inc. may charge, and you agree to pay, a fee of up to $50 in addition to other bank charges. All charges, terms and conditions are subject to change. PLEASE KEEP THIS AUTHORIZATION FOR YOUR RECORDS.
ON-LINE BILL PAYMENT (SET UP REGULAR, RECURRING OR SCHEDULED PAYMENTS).
BY COMPLETING THE ON-LINE BILL PAYMENT REGISTRATION INCLUDING SUPPLYING THE REQUIRED CHECKING ACCOUNT OR CREDIT CARD INFORMATION, YOU AUTHORIZE STAR GAS PRODUCTS, INC. TO STORE SUCH INFORMATION AND USE THE SAME TO DEBIT YOUR CHECKING ACCOUNT OR CHARGE YOUR CREDIT CARD ACCORDINGLY, PLUS ANY APPLICABLE TRANSACTION FEES, UNTIL YOU CANCEL THIS SERVICE (IF YOU WISH TO MAKE A ONE TIME PAYMENT ELECTRONICALLY, SEE THE PREVIOUS SECTION FOR OUR ONE TIME PAYMENT SERVICE). YOUR PAYMENTS WILL BE DEBITED FROM YOUR CHECKING ACCOUNT OR CHARGED TO YOUR CREDIT CARD ON THE SPECIFIED DATE. (IF THIS DAY FALLS ON A WEEKEND OR HOLIDAY, THE DEBIT WILL OCCUR ON THE FOLLOWING BUSINESS DAY.) YOU ALSO AUTHORIZE SUBURBAN PROPANE TO, UPON NOTIFICATION BY YOU OR YOUR FINANCIAL INSTITUTION, MODIFY AND/OR UPDATE THE ACCOUNT NUMBERS, EXPIRATION DATES, OR OTHER PERTINENT INFORMATION ASSOCIATED WITH ON-LINE BILL PAYMENT AS NECESSARY TO COMPLETE ANY AUTHORIZED TRANSACTION. PLEASE REVIEW YOUR STATEMENT/INVOICE FOR ACCURACY. YOU UNDERSTAND AND AGREE THAT STAR GAS PRODUCTS, INC. IS NOT LIABLE FOR INCORRECT DEBITS TO YOUR ACCOUNT RESULTING FROM ERRORS ON YOUR STATEMENT/INVOICE (SEE THE SECTION ABOVE FOR HOW YOU CAN REPORT ERRORS ON YOUR STATEMENT/INVOICE TO STAR GAS PRODUCTS, INC.). STAR GAS PRODUCTS, INC. HAS THE RIGHT TO TERMINATE THIS ON-LINE BILL PAYMENT SERVICE AT ANY TIME UPON NOTICE TO YOU. YOU MAY DISCONTINUE THIS ON-LINE BILL PAYMENT SERVICE AT ANY TIME UPON 30 DAYS ADVANCED WRITTEN NOTICE TO STAR GAS PRODUCTS, INC., ATTN: CASH APPLICATION DEPARTMENT, OR BY CONTACTING CUSTOMER SERVICE AT 1-845-452-8400. OR SENDING AN EMAIL TO CINDY@STARGASPRODUCTS.COM. THIS CANCELLATION APPLIES TO YOUR ONLINE PAYMENT SERVICES ONLY AND DOES NOT TERMINATE YOUR STAR GAS PRODUCTS, INC. ACCOUNT. THIS AUTHORIZATION DOES NOT ALTER IN ANY WAY THE TERMS AND CONDITIONS OF YOUR CUSTOMER AGREEMENT WITH STAR GAS PRODUCTS, INC. . STAR GAS PRODUCTS, INC. IS NOT RESPONSIBLE FOR ANY FINANCIAL INSTITUTION FEES YOU MAY INCUR AS A RESULT OF YOUR PARTICIPATION IN THIS PROGRAM.
